15. Conduct of business: Every member of the Legislative assembly or the legislative assembly or the legislative council of a state shall , before taking his seat , make and subscribe before the Government , or some person form set out for the purpose in the third schedule.
1.     Voting in houses power of houses to act notwithstanding vacancies and quorum-

  1. Save as otherwise provided in this constitution , all question at any sitting of a house of the Legislature of State shall be determined by a majority of votes of the members present and voting ,other than the speaker or chairman , or person acting as such. The speaker pr chairman or person acting as such , shall not voice in the first instance, but shall have and exercise a casting vote in the case of equality of votes.
  2. A house of the Legislature of a State shall have power to act notwithstanding any vacancy in the membership thereof , and any proceedings in the Legislature of a State shall be valid notwithstanding that it is discovered subsequently that some person who was not entitled so to do sat or voted or otherwise took part in the proceedings.
  3. Until the Legislature of the State by law otherwise providers, the quorum to constitute a meeting of a hose of the Legislature of a State shall be ten members or one – tenth of the total number of members of the house , whichever is greater.
  4. If at any time during a meeting of the legislative assembly or the legislative council of a State there is no quorum , it shall be the duty of the speaker or chairman , or person acting as such , either  to adjourn the house or to suspend the meeting until there is a quorum.

2.     Vacation of seats.-

  1. No person shall be a member of both houses of the Legislature of a State and provision shall be made by the legislature of the State by law for the vacation  by a person who is chosen member of both houses of this seat in one house or the other.
  2. No person shall be a member of the Legislature of two or more states specified  in the first schedule and if a person is chosen a member of the legislatures of two or more such States , then , at the expiration of such period as may be specified in rules made by the president , that person’s seat in the legislatures of all such States shall become vacant, unless he has previously resigned his seat in the legislatures of all but one of the States.
  3. If a member of a house of the Legislature of a State-
  4. Becomes subject to any of the disqualifications mentioned in clause (1) or clause (2) of article 191; or
Resigns his seat by writing under his hand addressed to the speaker or the chairman, as the case may be, and his resignation accepted by the speaker or the chairman, as the case may be, his seat shall thereupon become vacant: provided that in the case of any resignation referred to in sub – clause if from information received or otherwise and after making such inquiry as he thinks fit, the speaker or the chairman , as the case may be, is satisfied that such resignation is not voluntary or genuine , he shall not accept such resignation.
